Security of Tenure

The laws seek to provide some security of tenure for the residents of a village.

The Lease specifies the terms and conditions of the Estate Scheme and provides for your and the Lessor's rights. Your rights are protected by the Retirement Villages Act 1992 and the Code of Fair Practice for Retirement Villages 2009.

A Memorial has been registered against the title to the Village Land as required by the Retirement Villages Act 1992. The Memorial gives notice to all persons of the status of the land as a Retirement Village.

You do not lose your rights under the Estate Scheme if the Lessor of the Village land changes. Any new owner assumes the obligations imposed on the previous owner under the Village Scheme and Lease.
